On February 17, 2022, the Central Bank of Paraguay (BCP) issued Resolution N° 01, Acta N° 10, which established the rules for the admission of guilt (or acceptance of the facts) of obligated parties that have been notified of an administrative proceeding opened against them, as set forth in Articles 89 and 90 of Law Number 489/95, the Foundational Law of the BCP, as modified.
The new resolution establishes the procedure for the application of fines or sanctions without the need to previously conduct an administrative proceeding, in cases when the accused party has recognized the facts and admitted guilt. The recognition of facts and admittance of guilt entails reduced sanctions or fines. The new procedure includes, inter alia, the obligation of the supervising entity to communicate clearly and precisely, in writing, the acts which have given rise to the administrative proceedings and the fact that a recognition of the facts will be judged positively, and the deadlines and requirements for the obligated parties to file the response including a recognition of the facts and admittance of guilt.
