Recently, Decree No. 2.522/24 “establishing mechanisms to support and promote the Paraguayan metallurgical industry” (the Decree) was enacted.
The Decree introduces measures to promote the participation of the Paraguayan metallurgical industry in national and international tender processes called by the National Electricity Administration (ANDE) for the supply of metal structures.
Below is a summary of the key aspects of the Decree:
Benefited Metallurgical Industries: eligible beneficiaries are those metallurgical industries established in Paraguay that have a manufacturing plant, are registered in the Industrial Registry of the Ministry of Industry and Commerce (MIC), and have a registered payroll of employees in the Ministry of Labor and Social Security (MTESS);
Applicable Contracts: national and international tender processes called by ANDE, regardless of the funding source, related to the supply of all types of metal structures intended for power transmission lines, substations, or other similar projects;
Role of the MEF: the Ministry of Economy and Finance (MEF), in its role within the National Public Supply System (SNSP), must ensure compliance with the provisions of the Decree in all applicable tender processes;
Role of ANDE: ANDE must specify in the bidding terms of the relevant tender processes that the provisions of the Decree will apply;
Role of the DNCP: the National Directorate of Public Procurement (DNCP) must coordinate to ensure that control and verification mechanisms are in place as a condition for the release of the tenders covered by the Decree.
