NORDEX, which is a worldwide wind turbine generator manufacturer, will supply, install, operate and maintain 28 Wind Turbine Generators (WTGs), which will be owned by UTE.
On December 27, 2012 NORDEX and UTE entered into a WTG Supply and Installation Agreement and into an Operation and Maintenance Agreement. The parties also executed a Memorandum of Understanding to start negotiating a Balance of Plant Agreement (BoP).
FERRERE advised NORDEX during the negotiation of the three agreements, which took several weeks.
Gonzalo Secco, head of FERRERE’s Energy practice group, comments: “This deal is the first mega wind project launched by UTE (which up to date, only owns a 10 megawatt wind farm) and anticipates other investments of UTE in this area.”
Sebastián Ramos, who assisted Nordex in the negotiations with UTE, commented that: “Although UTE has been entering into Power Purchase Agreements with private owners of wind farms, its strategy is to also acquire this type of power plants to achieve energy independence from Argentina and Brazil. This was an intense negotiation, in which both parties worked really hard to meet the target of executing the agreements before the end of year 2012.”
