On March 26, 2020, Decree No. 3488/2020 that modifies and regulates more specifically, the duty to cooperate with the Competition Authority (“CONACOM” for its Spanish acronym).
Below we summarize the most relevant provisions:
- It establishes a general duty to provide information to the CONACOM, including providing documents, and the obligation to participate in oral hearings.
- Individuals, legal entities, directors, managers or representatives of legal entities (if they intervene in the breach), as well as public servants, may be subject to fines in case of breach of the duty to provide information.
- Fines applicable to the private sector range between USD 130 and USD 3,850 approximately. Fines may be doubled successively without limit.
