The bill of the "Law of regularization in the payment of debts and fines of national tax domain" has been officially published in the Bolivian Chamber of Deputies. In the course this week the bill of law N° 300/18 will be dealt with in the Plurinational Legislative Assembly.
Below we detail the most relevant aspects regarding the regularization of tax debts in the different scenarios:
- Taxpayers with procedures or Payment Facilities.
Full payment until October 31, 2018: | 95% reduction in penalties and 100% in interest and in Fines for Noncompliance with Formal Duties (FNFD). |
Full payment between October 31 and January 31, 2019: | 90% reduction in penalties and FNFD, and 100% in interest. |
Payment through Payment Facilities (FAP) until January 31, 2019: | 80% reduction in penalties and FNFD, and 100% in interest. |
- Taxpayers without procedures for debts prior to 2015.
Not registered / incorrectly registered.- | They will be able to consolidate VAT, Corporate Income Tax and Transaction Tax debts by paying a 12% rate over 9% of the annual purchases of the last three years. |
Registered in the General Regime.- | They will be able to consolidate the VAT, Corporate Income Tax and Transaction Tax debts by paying a 12% rate over the average of the annual income of the last three years. In case the Tax Identification Number is inactive, the debt will be calculated on the pre-inactivation years. |
VAT - Complementary Regime Taxpayers | They will be able to pay the amount of 4% on the salaries or net remuneration of 2017. |
Other aspects to consider
- Taxpayers who are in any stage of judicial/administrative proceedings must submit a withdrawal to benefit from the reductions established in the law.
