On January 30, 2023, the Executive Branch approved a publicly initiated project under Law No. 5102/2013 regarding Public-Private Partnerships ("PPP").
Project: The project consists of the expansion and improvement of 108 kilometers of the highway Ruta PY01, from Cuatro Mojones to Quiindy.
Investment: Approximately USD 400,000,000.
Below, a description of the next stages of the PPP process:
- Prequalification: It is estimated that the Ministry of Public Works and Communications ("MOPC") will issue a call for prequalification in February. The prequalification may only refer to aspects related to legal capacity, financial or technical capacity, and experience in other works executed in the past by the bidders.
- Competitive Dialogue: In this stage, the prequalified bidders, together with their potential financiers, may ask questions and submit proposals for improvements to the draft bidding terms and conditions, as well as to the draft PPP contract. Although the proposals made by the prequalified bidders are not binding for the MOPC, the competitive dialogue aims to achieve greater harmonization of PPP projects, so that the bidding terms and conditions are not subject to changes during the bidding process, and awarding the project is feasible.
- Bidding Process: Once the competitive dialogue stage is closed, the MOPC will issue a call for bids. Only prequalified bidders may participate in the bidding process. Legal entities, local or foreign, individually or in consortium, that comply with the conditions specified in the PPP Law, the regulatory decree, and the bidding terms and conditions, may participate in the bidding process.
