Ministry of Labor Resolution No. 55/2020, dated March 23, 2020, authorizes companies to move up vacation generated by workers during this year.
Which workers and sectors are included?
Employees and companies in all activity groups and subgroups are covered.
In what circumstances it is permitted?
The rule permits moving up vacation generated in 2020 only in health emergency situations and provided it is beneficial to both parties to the employment relationship.
What requirements must be met?
- The arrangement must be documented in a written agreement setting out the consent of both parties to the employment relationship.
- It must establish the cause as the health emergency decreed by the Executive Branch.
- The agreement must be for the total vacation generated or a fraction agreed to of not less than 10 days.
- The pertinent payment for vacation time and vacation pay must be paid per labor rules.
- The written agreement executed by the parties to the employment relationship must be submitted to the Ministry of labor and Social Security so as to inform the General Inspectorate of Labor and Social Security.
