FERRERE Abogados Uruguay assisted Zamin Ferrous, a foreign mining investor, on a challenge of a judicial ruling handed down in the context of an action brought by environmentalists for access to information held by government agencies. The ruling had ordered the Ministry of Industry, Energy and Mining to deliver all information related to the Zamin mining project, which it had disclosed in order to obtain mining exploitation permits.
Shortly after the 2015 ruling ordering the government to disclose all information related to the project, Zamin appeared in the process pending between the government and environmentalists, arguing that the information related to the mines, resources, and financial viability of the project should be exempt from disclosure. On May 4, 2016 the Appeals Court ruled in favor of Zamin and held that the information should be protected by industrial and commercial secrecy and remain confidential.
